Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and TicketDawg, LLC ("TicketDawg," "we," "us," or "our"), the company that operates the Graveyard Shift employee scheduling platform ("Service").
By creating an account, accessing, or using the Service in any way — including on behalf of your organization — you agree to these Terms. If you do not agree, you must not use the Service.
If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.
Definitions
- "Service" / "Platform"
- The Graveyard Shift web application and all related features, APIs, and tools provided by TicketDawg at
graveyardshift.ticketdawg.comand associated subdomains. - "Account"
- The unique organizational workspace created for a Customer, accessible via a dedicated subdomain (e.g.,
yourbusiness.graveyardshift.ticketdawg.com). - "Customer Data"
- All data, content, and information submitted to or stored within the Service by you or your authorized users, including employee records, scheduling data, and communications.
- "User"
- Any individual who accesses the Service under your Account, including administrators, managers, and employees.
- "Subscription"
- A paid plan granting access to the Service for a defined period and employee tier.
Description of Services
Graveyard Shift is a SaaS employee scheduling and workforce management platform designed specifically for haunted attractions and seasonal entertainment venues. Features include, but are not limited to:
- ▪Multi-date event creation and management
- ▪Drag-and-drop staff scheduling with conflict detection
- ▪Area and position management for themed attractions
- ▪Employee availability tracking and submission workflows
- ▪Costume and wardrobe inventory management
- ▪Messaging and notifications via email and SMS
- ▪Time clock and attendance tracking
- ▪Automated shift reminders and no-show alerts
We reserve the right to modify, add, or discontinue features at any time. Material changes that negatively affect your core usage will be communicated with at least 30 days' notice when practicable.
Accounts & Registration
Account Creation
To use the Service, you must create an Account by providing accurate and complete information. You agree to keep your account information current and notify us promptly of any changes.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must not share credentials between users; each User must have their own login. Notify us immediately at support@ticketdawg.com if you suspect unauthorized access.
Administrator Responsibilities
The Customer's designated account administrator ("Admin") is responsible for managing user access, ensuring all Users comply with these Terms, and for the security and appropriate use of the Account. TicketDawg will not be liable for losses caused by unauthorized access resulting from the Customer's failure to maintain proper security practices.
Age Requirement
You must be at least 18 years old to create an Account or enter into these Terms on behalf of an organization. The Service may be used by employees who are minors (where permitted by applicable law) under the supervision of the account administrator.
Subscriptions & Payment
Subscription Plans
The Service is offered on an annual subscription basis at the following tiers:
- ▪Starter (Small Haunt): $300/year — up to 25 employees
- ▪Professional (Growing Haunt): $450/year — up to 100 employees
- ▪Enterprise (Major Haunt): $900/year — unlimited employees
All plans include access to the full feature set. SMS messaging can be purchased in increments of 1,000 text messages for $25.
Payment Terms
Annual subscription fees are due in full at the time of purchase or renewal. We accept payment via major credit cards processed through our payment provider. All fees are in U.S. dollars.
Renewals & Cancellation
Subscriptions renew automatically at the end of each annual term unless cancelled. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — you retain full access until then.
Refund Policy
Subscription fees are generally non-refundable. If you experience a material service failure attributable to TicketDawg, please contact us within 30 days. We will evaluate refund or credit requests on a case-by-case basis. Disputes may be escalated per Section 14.
Price Changes
We reserve the right to change subscription pricing. Any price increase will be communicated at least 30 days before your next renewal date. Your continued use after the new pricing takes effect constitutes acceptance.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- ▪Use the Service in any way that violates applicable federal, state, local, or international law or regulation
- ▪Transmit any unsolicited or unauthorized advertising, promotional material, or spam via the messaging features
- ▪Upload or transmit any material that infringes any intellectual property right or contains harmful, offensive, or defamatory content
- ▪Attempt to gain unauthorized access to the Service, other Accounts, or related systems
- ▪Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- ▪Reverse engineer, decompile, or disassemble any portion of the Service
- ▪Use automated bots, scrapers, or data extraction tools without prior written consent
- ▪Reproduce, duplicate, copy, sell, or resell access to the Service without authorization
- ▪Use the Service to store or transmit malicious code or conduct phishing attacks
We reserve the right to suspend or terminate access to any Account that we determine, in our sole discretion, is in violation of these acceptable use standards.
SMS Consent & Communications
Graveyard Shift includes optional SMS text messaging features that allow your Employer (the company that subscribes to the Service) to send you operational text messages related to your work schedule and employment.
How SMS Consent Works
During employee registration or at any time in your account settings, you will see a "Communication Preferences" section where you can choose how you receive notifications. The image below shows this preference screen:

Types of Messages
SMS messages sent through the Service may include, but are not limited to:
- ▪Shift reminders and schedule notifications
- ▪Schedule changes and updates
- ▪Check-in reminders for upcoming shifts
- ▪Time-sensitive operational communications from your Employer
Message Frequency
Message frequency varies based on your Employer's scheduling activity and operational needs. You may receive multiple messages per week during active event seasons.
Opt-Out
Consenting to SMS messages is entirely voluntary and is not a condition of employment or a requirement for using the Service. You may withdraw your consent and stop receiving SMS messages at any time by unchecking the "SMS text messages" option in your Communication Preferences. Changes take effect immediately. You may also contact your Employer's account administrator to request removal from SMS communications.
Message & Data Rates
Standard message and data rates may apply depending on your mobile carrier and plan. TicketDawg is not responsible for any charges incurred from your carrier for receiving SMS messages.
Data & Privacy
Your Data
You retain ownership of all Customer Data you submit to the Service. By using the Service, you grant TicketDawg a limited, non-exclusive license to process and store your Customer Data solely to provide and improve the Service.
Employee Data
You, as the Customer, are the data controller for employee information entered into the Service (including names, contact details, emergency contacts, and medical information). You represent that you have obtained all necessary consents and authorizations required by applicable law to collect and process this information.
Data Security
We implement commercially reasonable technical and organizational security measures to protect Customer Data against unauthorized access, loss, or disclosure. However, no security system is impenetrable, and we cannot guarantee absolute security.
Data Retention & Deletion
Upon cancellation or termination of your Account, we will retain your Customer Data for 90 days, during which time you may request an export. After 90 days, data will be permanently deleted from our systems, subject to any legal retention obligations.
Privacy Policy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Intellectual Property
Our Intellectual Property
The Service and all content, features, and functionality — including software, text, graphics, logos, icons, and the Graveyard Shift brand — are owned by TicketDawg and protected by U.S. and international copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business operations during your subscription term.
Your Content
You retain all rights in Customer Data you submit. By submitting content to the Service, you grant TicketDawg a limited license to use, process, and display that content solely to operate and improve the Service.
Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant TicketDawg a royalty-free, worldwide, perpetual license to use and incorporate that feedback without restriction or compensation to you.
Disclaimers & Warranties
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components. We do not warrant that the results obtained from using the Service will be accurate or reliable.
Planned maintenance will be communicated in advance where possible. We target 99.5% uptime on an annual basis but do not guarantee any specific availability SLA.
Limitation of Liability
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless TicketDawg and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- ▪Your use of the Service in violation of these Terms
- ▪Your Customer Data, including any claims that it infringes third-party rights
- ▪Your violation of any applicable law or regulation
- ▪Any misuse of the messaging features, including TCPA violations
- ▪Any breach of your representations and warranties under these Terms
Termination
Termination by You
You may cancel your Subscription at any time. Upon cancellation, you will retain access through the end of your current billing period. You may export your data during this period and for 90 days following termination.
Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:
- ▪You materially breach these Terms and fail to cure such breach within 10 days of written notice
- ▪We determine you are engaged in fraudulent, abusive, or harmful activity
- ▪Required to do so by law or regulatory authority
- ▪You fail to pay fees when due, and do not cure the non-payment within 7 days of notice
Effect of Termination
Upon termination, your license to use the Service ceases immediately. All provisions of these Terms which by their nature should survive termination will survive, including intellectual property rights, disclaimers, indemnification, and limitations of liability.
Governing Law & Disputes
Governing Law
These Terms and any disputes arising from them are governed by the laws of the State of Alabama, without regard to its conflict of law provisions.
Informal Resolution
Before initiating any formal dispute process, you agree to contact us at support@ticketdawg.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Alabama, and the award shall be final and binding. You waive any right to a jury trial or to participate in a class action lawsuit.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will notify you by email and/or by displaying a prominent notice within the Service at least 14 days before the changes take effect.
Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
The "Last Updated" date at the top of this page indicates when these Terms were most recently revised. We encourage you to review these Terms periodically.
